Penalties for Retail Theft

The misdemeanor offense of retail theft is a Class A misdemeanor, with a potential penalty of up to 364 days in jail and a maximum fine of $2,500. The defendant would be eligible for supervision, which is not a conviction and can be expunged. An offender sentenced to a jail sentence for retail theft must serve at least 50 percent of their time.
